SENTENCES OF NOBILITY
Martelletto-Giudice.png

A norma dell’art.

The judgment issued by the International Tribunal of Nobility, a permanent body of the Supreme Court of Justice of Nobiliaries Arbitration of Bari, a Court composed of arbitration magistrates, first-instance judges, seeks to establish, incidentally, the noble status of the entitled person, legally legitimizing the entitlement to the noble title, predicate, coat of arms, and existing and established qualifications.

Pursuant to Article 1, paragraph 2, of the New York Convention of June 10, 1958, ratified and enforced in Italy by Law Nr. 62 of January 19, 1968, published in the Official Journal of the Italian Republic Nr. 46 of February 21, 1968, decisions of permanent international arbitration bodies must be referred to as "sentence". These arbitration awards have the same effects, pursuant to Article 824 bis of the Italian Code of Civil Procedure, as awards rendered by the Judicial Authority of the Italian Republic.
Article 832 of the Italian Code of Civil Procedure, paragraph 1, provides that the arbitration agreement may refer to pre-established arbitration rules. The Noble Tribunal adopts as its own rules the "UNCITRAL Arbitration Rules – United Nations International Commission on Law and Trade," adopted and approved by Resolution 31/98 of the United Nations General Assembly, with the relevant adaptations to the needs of noble justice and modernizations regarding the jurisdictional assessment of noble estates.
The Court expressly refers to the rules of classical international noble law, to royal norms and provisions, and to subsequent case law on heraldic, noble, and chivalric matters.

Law Nr. 218 of May 31, 1995, reforming the Italian system of private international law (and procedural law), in Article 64, first paragraph, states: "A foreign sentence is recognized in Italy without the need for any further proceedings." Therefore, for its enforceability, it is no longer necessary to resort to the special procedures of homologation before the ordinary tribunal.
